As Air Force veterans, my husband and I learned the hard way that the pool industry can sometimes lack the very thing we value most: Integrity. Five years ago, we were the ones getting the "run-around." We dealt with unanswered calls and a company that vanished into thin air, only to reopen under a new name, leaving our warranties worthless. 1. The "Red Flag" Checklist: How to Spot a Scam


Before you sign a contract or hand over a deposit, look for these warning signs:


  • The "Vague" Contractor: If the proposal has a blank space where the General Contractor (GC) License Number should be, or simply says "Licensed Contractor" without a number, stop. In NC, any project over $30,000 requires a licensed GC. Verify licenses at the NCLBGC website.

  • The DIY Permit Request: If a builder asks you to pull the permits as the "owner-builder," they are likely unlicensed. Never pull a permit for a professional builder; it leaves you legally and financially responsible for their mistakes.


  • The Name Game: Research if the owners had a previous pool company that went out of business. If they didn't honor old warranties, they likely won't honor yours. At Sunkissed Pools And Spas, our reputation is built on follow-through and honoring our word.


2. Payment Schedules & Timelines by Pool Type


Fiberglass & Fiberglass Plunge Pools


Timeline: 4–8 weeks (post-permit approval). Fiberglass requires a heavy upfront payment because the shell is custom-manufactured. Unlike concrete, the shell must be paid for in full before it leaves the factory. For a contractor, this is a $40k–$60k out-of-pocket expense.


  • 10% Deposit (Contract Execution): Covers site plan design and permit filings for Mecklenburg, Union, Iredell, or Cabarrus counties.

  • 40% Shell Order: Required BEFORE the shell is ordered. This covers the manufacturer's cost, custom features (colors/tiles), and specialized "wide-load" logistics.

  • 20% Excavation: Paid when heavy machinery arrives and the hole is dug.

  • 15% Set & Plumbing: Paid once the pool is set in the ground and plumbed.

  • 10% Hardscape: Paid when the concrete collar or pavers are being installed.

  • 5% Completion: Final walkthrough and water balance.


Gunite / Concrete Pools


Timeline: 3–6 months. Because these are built entirely on-site using raw materials (steel, concrete, plaster), the timeline is the longest in the industry. Payments are spread out to match these labor-intensive construction stages.


  • 10% Deposit: Engineering and design.

  • 25% Excavation & Steel: Once the hole is dug and the rebar is tied.

  • 25% Gunite Application: Once the concrete shell is shot.

  • 25% Tile, Coping & Deck: Once the masonry and patio work is done.

  • 15% Interior Finish & Startup: Paid before the final plaster.


Vinyl Liner Pools


Timeline: 4–8 weeks (post-permit approval). Vinyl pools offer a faster turnaround than gunite. They utilize a hybrid of pre-manufactured wall panels and a custom-fabricated liner. The timeline is efficient, but because the liner and wall kits are custom-ordered to the pool's specific dimensions, upfront deposits are necessary to secure materials.


  • 20% Deposit: Secures the build slot and triggers the custom order for the liner and wall kit.

  • 30% Excavation & Wall Set: Paid once the hole is dug and the steel or polymer walls are bolted and braced.

  • 30% Floor & Liner Installation: Paid after the "vermiculite" floor is poured and the liner is snapped into the track.

  • 15% Completion: Final deck work, electrical bonding, and system start-up.

  • 5% Final Walkthrough: The final "punch list" payment once the site is clean and the water is balanced.


3. What Your Contract MUST Include (The "No Surprises" Clause)


A professional contract should clearly define what is included and, more importantly, what is considered an additional cost outside of the proposal.


The "Hidden Earth" Clauses


In the Charlotte area, the ground can be unpredictable. Your contract should specify that the following are outside the base price:


  • Rock Clause: If the excavator hits "Charlotte Granite," you will be charged for specialized equipment (blasting or hydraulic hammers) by the hour or day.

  • High Water Table: If the dig reveals a high water table (common near our lakes), additional drainage systems like "de-watering" sumps may be required to prevent the pool from "floating" or popping out of the ground.


Water-Fill & Transportation


Who fills the pool? This should be explicitly stated:


  • Homeowner Fill: Some builders allow you to use a garden hose or well. However, this can take days and may lead to mineral staining or, in the case of wells, running your pump dry.

  • Water Hauling: Many reputable companies (including ours) include or strongly recommend professional water delivery. Why? It protects the integrity of the pool. For fiberglass and vinyl pools, the weight of the water provides the necessary pressure to hold the shell/liner in place during backfilling.


Transparency Checklist


Ensure your contract isn't left blank on these items:


  • Specific Warranty terms (Structural vs. Equipment).

  • Detailed Scope of Work (What is NOT covered, like landscaping or electrical sub-panels).

  • Communication Plan (Who is your point of contact?).


The "Lender-Proof" Contract: Getting Your Draw Approved


When financing your pool, the lender isn't just looking at the price; they are looking at the Draw Schedule. If your contract is vague, a lender might refuse to release the 40% needed to order your shell, stalling your project before it starts.


The Verbiage Your Contract Needs


To ensure your lender understands the unique requirements of a fiberglass build, the contract should include specific verbiage such as:


"Phase 2 Milestone: Custom Shell Fabrication & Logistics. This draw represents the acquisition of a pre-manufactured, custom-ordered fiberglass pool shell. Manufacturers require 100% payment of the shell cost, custom finishes, and specialized wide-load logistics prior to factory release. This phase constitutes a non-refundable custom equipment purchase to be registered in the Homeowner’s name."

By defining the shell as a "Pre-manufactured Custom Equipment Purchase," you help the lender understand that the money isn't just a "down payment"—it is a direct material purchase required for the project to exist.

  • Defined Milestones (when and why money is released).

  • Clear Exclusions (who pays for rock, water, and dirt).
